Personal Data

In order to access to and use some of the portal’s services, it is necessary for users to provide certain personal data. These data are stored in an automated file, which is registered before the competent authority, and the responsible of which is AUTEC.
These data are mainly used to provide services or to send messages regarding the portal’s operation, and commercial or advertising messages, but always with the user’s previous express consent. Under no circumstance will the data be disclosed to third parties.
AUTEC is fully committed to protecting the privacy of the users of its services, and, for this purpose, it has security measures which prevent the disclosure of personal data and the access to said data by unauthorized people. Use of Cookies

AUTEC reserves the right to modify, increase, or cancel the services provided. The new services shall be subject to these general terms and to the specific terms, if any.

Users’ Obligations

The User promises to use the portal and its services in accordance with the law and with the provisions of these terms of use. The use of the portal and its services for illegal purposes, for activities different to those of the portal, or to the detriment of third parties’ rights and interests is prohibited. It is also forbidden to use the portal in such a way that it may damage the portal and its services, render them useless, or overload them, so that other users cannot use the portal and services in a normal way.
The user shall also refrain from:

• Using vulgar, obscene, insulting or defamatory language in the portal.
• Transferring or sending files or programs containing viruses or any other mechanism intended to control, affect or damage third parties’ computers or data.
• Disclosing to or trading with third parties the portal’s contents and services.
• Violating national and international laws and regulations in force.

AUTEC shall be able to deny access to the portal and its services to users who, at its own discretion, have failed to comply with any of the above mentioned obligations, not being necessary to send previous notice and with no right to claim whatsoever.

Any kind of exploitation of the contents of this portal without the previous express authorization to do so by the corresponding owners is strictly forbidden, including the reproduction, distribution, transfer to third parties, public communication, and transformation, through any means. Failure to comply with this prohibition shall be considered as an offense punishable by the laws in force.
However, on his/her own behalf and at his/her own risk, the user shall be able to download or copy the contents for his/her personal use only. He/She shall not change, modify or eliminate said content, whether in part or in whole. This shall not mean any authorization or permission of ownership whatsoever.
It is forbidden, except as otherwise specifically authorized, to set links or hyperlinks from third parties’ portals or web sites to “MERCAPESCA” web pages different from the portal’s home page, accessible at the URL http://www.mercapesca.net. In addition, it is not allowed to present “MERCAPESCA” web pages or the information contained in them under frames, distinctive signs, brands or corporate or trade names belonging to another person, company or entity.

Under no circumstance shall AUTEC be responsible for any damage, whether direct or indirect, consequential damages or loss of earnings related to the use or the impossibility to use the portal.
Access to the portal and use of its services are at the users’ cost and risk.

• AUTEC does not guarantee the accuracy of all the information and documentation, and the precision of the services provided.
• AUTEC does not guarantee the continued access to or the correct display, downloading or operation of the elements and contents of the “MERCAPESCA” portal web pages due to problems caused by factors or circumstances beyond its control.
• AUTEC shall not be responsible for the contents of third parties’ web pages accessible from the “MERCAPESCA” portal through links, or for the contents of third parties’ web pages accessed to by links to the “MERCAPESCA” portal or any of its web pages, or for the contents of any third parties’ web page presented under the appearance or distinctive sign of “MERCAPESCA”, unless otherwise specifically authorized by AUTEC.

Jurisdiction

This agreement shall be governed by the Spanish laws and shall be subject to the jurisdiction of the courts of Girona.
